RETURN, REFUND & EXCHANGE POLICY

This Return, Refund & Exchange Policy ("Policy") governs all purchases made from GoRSA ("the Company", "we", "our", or "us"). By placing an order with GoRSA, the customer ("Customer", "you", or "your") acknowledges that they have read, understood, and accepted this Policy.

This Policy is governed by the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and all other applicable laws of the Republic of South Africa.

Where any provision of this Policy conflicts with applicable legislation, the applicable legislation shall prevail.


1. GENERAL PRINCIPLES

GoRSA is committed to supplying products of acceptable quality and providing fair after-sales support.

All return requests are subject to inspection, verification, and approval by GoRSA.

Submission of a return request does not constitute acceptance of the return.

GoRSA reserves the right to refuse any return that does not comply with this Policy or applicable South African legislation.


2. SIX-MONTH IMPLIED WARRANTY

In accordance with Section 56 of the Consumer Protection Act, every product sold by GoRSA carries an implied warranty of quality for a period of six (6) months from the date of delivery.

Should a product fail to comply with the standards contemplated in Section 55 of the CPA, the Customer may return the product for inspection.

Where the defect is confirmed, the Customer may elect one of the following remedies:

• Repair of the product;
• Replacement of the product; or
• Refund of the purchase price.

GoRSA reserves the right to inspect, assess and test any returned product before determining whether the product qualifies under the CPA.

The warranty shall not apply where the product has been:

  • Misused;
  • Neglected;
  • Modified;
  • Improperly installed;
  • Subjected to accidental damage;
  • Used contrary to the manufacturer's instructions;
  • Tampered with;
  • Repaired by an unauthorised person;
  • Damaged through normal wear and tear.

3. DELIVERY DISCREPANCIES

Customers are required to inspect all deliveries immediately upon receipt.

Any of the following must be reported within forty-eight (48) hours of delivery:

  • Incorrect product supplied;
  • Missing items;
  • Physical damage;
  • Packaging damage;
  • Manufacturing defects visible upon delivery.

Failure to notify GoRSA within the above period may result in the claim being declined where the delay materially prejudices the Company's ability to investigate the claim.

Customers must provide:

  • Order Number;
  • Clear photographs;
  • Description of the issue.

4. CHANGE OF MIND RETURNS

Except where required by applicable law, GoRSA is under no legal obligation to accept returns where the Customer:

  • Ordered the incorrect item;
  • No longer requires the product;
  • Purchased the wrong size or colour;
  • Changed their mind;
  • Found the item elsewhere at a lower price.

Should GoRSA, in its sole discretion, agree to accept such return, the following conditions shall apply:

  • Return request within seven (7) calendar days;
  • Product unused;
  • Original packaging intact;
  • All accessories included;
  • No signs of installation or use;
  • Product capable of resale as new.

GoRSA reserves the right to deduct a reasonable handling, collection, administration and restocking fee where permitted by law.

Original courier charges remain non-refundable.


5. NON-RETURNABLE GOODS

Unless defective under the CPA, GoRSA will not accept returns of:

  • Clearance products;
  • Final sale items;
  • Gift cards;
  • Digital products;
  • Downloadable software;
  • Personalised products;
  • Custom-made products;
  • Hygiene products;
  • Personal care products;
  • Food products;
  • Consumable goods;
  • Products with broken security seals;
  • Products specifically marked as non-returnable.

6. RETURN CONDITIONS

Products must be returned:

  • In their original condition;
  • Complete with all accessories;
  • Including manuals;
  • Including proof of purchase;
  • Properly packaged;
  • Without physical damage caused after delivery.

GoRSA may reject returns where products have been damaged after delivery or are no longer suitable for resale.


7. RETURN SHIPPING

Where the return results from:

  • A defective product;
  • Incorrect delivery;
  • Manufacturing defect;
  • Error by GoRSA,

GoRSA shall arrange collection or reimburse reasonable courier costs where appropriate.

Where the return is voluntary, including change-of-mind returns, the Customer shall be responsible for all shipping, insurance and handling costs.

Risk in returning products remains with the Customer until received by GoRSA.


8. INSPECTION PROCESS

All returned products undergo a detailed inspection.

Inspection may include:

  • Physical examination;
  • Functional testing;
  • Manufacturer assessment;
  • Supplier verification.

Inspection generally requires between three (3) and seven (7) business days but may take longer where manufacturer testing is required.


9. REFUNDS

Approved refunds shall be processed using the original payment method unless otherwise agreed.

Refunds will only be processed after:

  • Inspection has been completed;
  • Return approved;
  • Goods received by GoRSA.

Bank processing times remain outside the Company's control.

Shipping charges shall only be refunded where legally required.


10. EXCHANGES

Exchanges are subject to product availability.

Where replacement stock is unavailable, GoRSA may provide:

  • A comparable replacement;
  • Store credit;
  • Refund where required by law.

11. FRAUD PREVENTION

GoRSA reserves the right to decline any claim where there is evidence of:

  • Fraud;
  • Abuse of the returns process;
  • Excessive return patterns;
  • False claims;
  • Missing serial numbers;
  • Removed labels;
  • Tampered packaging;
  • Swapped products;
  • Intentional damage.

Fraudulent conduct may be referred to the South African Police Service and relevant regulatory authorities.


12. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, GoRSA shall not be liable for:

  • Indirect damages;
  • Consequential damages;
  • Loss of profits;
  • Loss of income;
  • Loss of business;
  • Incidental damages;
  • Third-party claims arising from misuse of any product.

GoRSA's maximum liability shall not exceed the purchase price actually paid for the relevant product, except where otherwise required by law.

Nothing contained herein limits any rights afforded to consumers under the Consumer Protection Act.


13. FORCE MAJEURE

GoRSA shall not be liable for any delay or failure in performing its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, civil unrest, pandemics, government restrictions, transport disruptions, supplier shortages or acts of God.


14. GOVERNING LAW

This Policy shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any dispute arising from this Policy shall be subject to the exclusive jurisdiction of the competent courts of South Africa.

GoRSA reserves the right to amend this Policy at any time without prior notice. The version published on the Company's website at the time of purchase shall apply to that transaction, unless amended to comply with applicable legislation.
